§ 12-139. Reports; identification and age requirements for sellers.

  • (a)

    Every person in the unincorporated portion of the parish engaged in the business of purchasing for resale any kind of scrap or salvage metals or any salvage vehicles (such persons hereinafter referred to as "dealers") shall, within 24 hours of each transaction for the purchase of any such scrap or salvage metal or vehicle, complete and deliver to the sheriff of the parish, in the manner and form required by him, a report of such transaction, which report shall include:

    (1)

    The seller's driver's license number and state of issuance, the seller's military identification card number, or the seller's state identification card number;

    (2)

    The seller's age as evidenced by said identification card;

    (3)

    The vehicle license number of the vehicle that delivers the metal or vehicle purchased; and

    (4)

    A complete description of the metal or vehicle purchased.

    (b)

    Each dealer shall keep the copy of such completed report in a separate register or book which shall be kept for a period of two years at his place of business and which shall be made available for inspection by any peace officer or law enforcement official at any time requested.

    (c)

    Failure to maintain the register or to report to the sheriff as required by this section shall be prima facie evidence that the person receiving such metal or vehicle and not registering or reporting same received it knowing it to be stolen, in violation of R.S. 14:69.

    (d)

    No dealer shall purchase or accept any scrap or salvage metal or salvage vehicle unless the seller is at least 18 years of age and provides, for identification, a valid driver's license, a military identification card, or a state identification card issued by the motor vehicle office of the state department of public safety.

    (e)

    Notwithstanding the foregoing provisions of this section, no age or reporting requirements shall apply to the purchase or acceptance by a dealer of any food or beverage cans.

    (f)

    With regard to vehicles, the requirements of this section shall be applicable only to open title and no title transfers thereof.
