§ 16-1. Emergencies.

  • (a)

    Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    Emergency, as defined in the Louisiana Revised Statutes as it applies to the construction, repairs or alterations, means an unforeseen mischance, bringing with it destruction of life or property or the eminent threat of such destruction or as the result of an order from any judicial body to immediately undertake construction or repairs to comply with a court order. This provision shall not apply in instances of restoration of interruptions to services of publicly owned utilities, such as, but not limited to, water, gas, sewerage, or electrical services.

    (b)

    Notice of public emergency. In cases of extreme public emergency, where such emergency has been certified to by the parish commission, notice of such public emergency shall, within ten days thereof, be published in the official journal of the commission. In addition, this shall not apply for labor necessary and used in the maintenance of public works built and completed.
