§ 26-128. Off-road origination hauling permit.

  • (a)

    Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    Off-road origination hauling means any commercial hauling which does not originate from a permanent location.

    Permanent location means a location having a permanent municipal or 911 address, permanent structure, and employees stationed at the location on a full-time basis.

    (b)

    Permit required. Whenever it shall be necessary to engage in off-road origination hauling, the owner or operator of the vehicle or conveyance engaged in such off-road origination hauling shall apply to the director of public works for special permission to travel on parish roads, except as otherwise provided in sections 26-123 through 26-127. Such special permission shall be granted to any applicant who satisfies and agrees to abide by the conditions stipulated under the parish's off-road origination hauling permit policy.

    (c)

    Conditions of permit.

    (1)

    The parish administrator shall have the authority to establish and issue the parish's off-road origination hauling permit policy.

    (2)

    In addition to any other conditions of the off-road origination hauling permit policy, the policy shall require each applicant for a permit to submit to the parish a cash deposit, bond, or evidence of insurance, and the security or insurance shall be maintained on a yearly basis.
