§ 46-1. Area of applicability.

  • The requirements of this chapter shall apply as described herein:

    (1)

    The provisions of this chapter shall apply to all stormwater discharges in the parish and site development activities requiring permits and approvals as defined in section 18-40, both public and private, within the bounds of the parish, excluding incorporated areas of the City of Shreveport, the Cross Lake Watershed, and the Town of Vivian.

    (2)

    The provisions of this chapter shall apply to all situations and circumstances throughout the parish, excluding incorporated areas of the City of Shreveport, the Cross Lake Watershed, and the Town of Vivian.

    (3)

    Any land development which is required by operation of any parish ordinance, state law or federal law to construct, install or modify any natural or manmade drainage features within, abutting, or serving the development shall do so in accordance with this chapter. However, where the provisions of this chapter directly conflict with any other parish ordinance, state law or federal law, or comprehensive drainage plan, the more stringent provisions shall apply to the extent permissible by law.

    (4)

    Approval of any land development activity by the parish does not constitute approval of other applicable permits that may be required by other agencies. Examples of additional permits that may be required include construction and industrial water discharge permits administered by the state department of environmental quality under the Louisiana Pollutant Discharge Elimination System (LPDES) program, wetlands and waterways permits administered by the United States Army Corps of Engineers, and Cross Lake Watershed permit by the City of Shreveport.
