§ 52-55. Where community-type system not available.

  • Where community-type systems are not available, an individual system may be used subject to the following requirements:

    (1)

    Each residence or commercial structure within a building site area shall be surrounded by a minimum of 25,000 square feet of land if a public water system utilizing a community water supply as defined by R.S. 40:5.8 is used. The land area required shall be one acre if an individual water well is used.

    (2)

    A soil absorption system for treated effluent must be approved by the health unit.

    (3)

    If a soil absorption system is not feasible, a spray irrigation system meeting effluent standards of the health unit may be utilized if approved by the health unit.

    (4)

    Effluent from all individual systems must be disposed of within the boundaries of the land area specified in subsection (1) of this section surrounding each residence or commercial structure upon which the sewage originated. Under no circumstances shall effluent be allowed to run off said land area.

    (5)

    Persons wishing to deviate downward from the standard required by subsection (1) of this section may appeal to the parish commission to request an exemption to be provided by ordinance. No appeal shall be entertained by the parish commission unless accompanied by the following:

    a.

    A comprehensive drainage plan for each lot provided by a licensed professional engineer, and health department approval of the plan;

    b.

    A statement from a licensed professional engineer certifying that there will be no adverse impact to any surrounding property.

    (6)

    Under no circumstances will a deviation be allowed below 22,500 square feet.
