§ 40-11. Discharge of effluent from individual sewerage disposal systems into drainage ditches.

  • (a)

    It shall be unlawful to allow the effluent from any individual sewerage disposal system, for either residential or business use, to discharge into the drainage ditches established for the drainage of the public streets and roads of this parish, located outside of incorporated municipalities, without first obtaining a permit to do so from the director of public works, provided, however, that no permit shall be required for such discharge from any system which is in place and operative upon the effective date of the ordinance from which this section is derived. The director of public works may deny the issuance of a permit for such discharge in any case wherein it is determined that the discharge would likely result in substantial hindrance to proper maintenance of the ditch, unreasonable odors, standing water which may foster the breeding of insects, or any other detriment to the public health and welfare.

    (b)

    Upon finding that any of the reasons herein stated for denial of a permit exist, the director of public works may, by written notice, require the owner or operator of any individual sewerage disposal system to cease allowing the effluent therefrom to discharge into drainage ditches, notwithstanding that such discharge has been previously permitted or predated the ordinance from which this section is derived. Upon the receipt of such notice the owner or operator so notified shall have 60 days to terminate the referenced discharge. Any such discharge occurring after the expiration of said period shall constitute violation of this section.
